Privacy Policy
Last updated: March 21, 2026
MACD Labs (“MACD Labs,” “we,” “us,” or “our”) operates Market Diary (the “Service”). This Privacy Policy explains how we collect, use, disclose, and protect information when you use the Service. It applies to users in the United States and elsewhere unless a separate notice applies.
1. Information we collect
Account and profile information. Such as name, email address, organization affiliation (if applicable), and credentials you provide when you register or update your account.
Content you provide. Information you enter or upload, including diary entries, tags, trade notes, files (for example screenshots, PDFs, or spreadsheets), and similar materials.
Usage and device information. Such as log data, IP address, browser type, device identifiers, approximate location derived from IP, pages or screens viewed, and timestamps. We may use cookies and similar technologies as described below.
Communications. If you contact us, we collect the content of your messages and related metadata.
Information from third parties. We may receive information from authentication providers, payment processors (if applicable), or other services you connect to the Service, consistent with your settings and their policies.
2. How we use information
We use the information we collect to:
- Provide, operate, maintain, and secure the Service;
- Authenticate users, personalize your experience, and manage organizations or sharing features you enable;
- Process and store User Content you submit, including uploaded files and backups and technical processing needed to run the Service;
- Share and use information within MACD Labs as described in Section 4;
- Improve and develop products and features, including troubleshooting, analytics, and aggregated or de-identified insights where permitted;
- Communicate with you about the Service, updates, security, and support;
- Detect, prevent, and respond to fraud, abuse, or technical issues;
- Comply with law, enforce our Terms of Use, and protect rights and safety.
In short, information you provide may be used by us to run and improve the Service and for the purposes above. We process information as described in this Policy and in our Terms of Use.
3. We do not sell your personal information
We do not sell your personal information to third parties for money or other valuable consideration. We also do not “share” personal information for cross-context behavioral advertising as defined under certain U.S. state laws. If our practices change in a way that constitutes a “sale” or “sharing” under applicable law, we will update this Policy and provide any required choices or notices.
4. How we disclose information
We may disclose information:
- MACD Labs. Within MACD Labs, personnel and internal systems may access or review information you provide—such as file uploads (screenshots, PDFs, spreadsheets, and other attachments), diary entries, and related metadata—for operations, security, compliance, analytics, and improvement of the Service and related products. See also our Terms of Use regarding uploaded files;
- Service providers. With vendors who assist us (for example hosting, storage, email delivery, analytics, security, and customer support), subject to confidentiality and use restrictions consistent with this Policy;
- Legal and safety. When we believe disclosure is required by law, legal process, or government request, or to protect rights, safety, and security of us, users, or others;
- Business transfers. In connection with a merger, acquisition, financing, reorganization, or sale of assets, subject to appropriate safeguards;
- With your direction. When you ask us to share information or use features that involve sharing (for example within an organization you join).
5. Cookies and analytics
We and our analytics partners may use cookies, pixels, and similar technologies to understand how the Service and our marketing sites are used. For example, our public website may use analytics hosted on our or a partner’s infrastructure. You can control cookies through your browser settings; disabling cookies may affect functionality.
6. Retention
We retain information for as long as your account is active, as needed to provide the Service, and as necessary to comply with legal obligations, resolve disputes, and enforce our agreements. Retention periods may vary depending on the type of data and legal requirements.
7. Security
We implement technical and organizational measures designed to protect information. No method of transmission or storage is completely secure; we cannot guarantee absolute security.
We prohibit bots, scrapers, automated agents, and AI or machine-learning crawlers from scraping, bulk-copying, or otherwise harvesting data from our public websites or the Service—including personal information or User Content you store with us—except where our Terms of Use expressly permit (for example, prior written permission or a documented API). That restriction helps limit unauthorized bulk collection of information about you and other users.
8. Your choices and rights
Depending on where you live, you may have rights under U.S. state privacy laws (including California, Colorado, Connecticut, Virginia, and others), such as rights to access, delete, or correct certain personal information, and to appeal our decisions regarding privacy requests. Because we do not sell personal information as described in Section 3, we do not offer a “sale” opt-out for that activity.
To exercise rights, contact us through the contact or support options provided on marketdiary.app or via macdlabs.com. We will not discriminate against you for exercising applicable privacy rights. You may also use an authorized agent where permitted by law, subject to verification.
9. Children
The Service is not directed to children under 13 (or under 16 where a higher age applies under state law), and we do not knowingly collect personal information from children. If you believe we have collected information from a child, contact us and we will take appropriate steps.
10. International users
We are based in the United States. If you access the Service from outside the United States, you understand that your information may be processed in the United States and other countries where we or our service providers operate, which may have different data protection rules than your country.
11. Changes to this Policy
We may update this Privacy Policy from time to time. We will post the updated Policy on this page and change the “Last updated” date. For material changes, we will provide additional notice as appropriate.
